Article 1 - Scope of Application

1.1

Any order placed via the website centphiltres.co implies full acceptance of these General Terms and Conditions of Sale by the Buyer, who acknowledges having read and accepted them without reservation and confirms being at least 18 years old.

The Buyer therefore waives the right to rely on any other terms or conditions unless expressly accepted by the Seller.

1.2

The Seller reserves the right to modify these General Terms and Conditions of Sale at any time. The applicable conditions shall be those in force on the date the order is placed by the Buyer.


Article 2 - Characteristics of the Goods Offered

2.1

Products offered for sale on centphiltres.co are reserved for adult individuals aware of the risks associated with their use, particularly the possible presence of nicotine in e-liquids, as well as the necessary precautions for use.

2.2

The products and services offered are those appearing in the catalog published on centphiltres.co.

These products and services are offered subject to stock availability.

In the event of product unavailability, the Seller will inform the Buyer by email or mail and may offer an exchange, refund, or store credit corresponding to the unavailable items within the legal period of 7 days, particularly in the event of supplier stock shortages.

2.3

The photographs displayed in the catalog are as accurate as possible but cannot guarantee perfect similarity with the delivered product.


Article 3 - Prices and Payment Terms

3.1

Prices are indicated in euros, inclusive of all taxes and VAT at the applicable rate. Prices may be modified at any time without prior notice.

Products are invoiced based on the prices displayed at the time the Buyer validates the order.

Shipping and transportation costs are calculated separately and displayed in the order summary.

For purchases made internationally or from French overseas territories (DOM-TOM), the Buyer is responsible for customs clearance and payment of any applicable import duties and taxes.

3.2

Products are payable in full at the time of ordering unless otherwise specified by the Seller.

No partial payment will be accepted, and no order will be shipped before full payment has been received, either via online payment, check, or bank transfer.

Payments made on centphiltres.co are processed through a secure payment system ensuring encrypted transmission of information.

Checks in euros issued by French banks are accepted free of charge. Checks issued by non-French banks are not accepted.

The order number and corresponding check must be sent to Cent Philtres.

3.3

Invoices are never included in shipped packages. They are available in the “My Account” section.


Article 4 - Delivery

4.1

Delivery of products and services presented on centphiltres.co is currently limited to mainland France, French overseas territories, and certain international destinations.

4.2

Products are delivered directly to the address provided by the Buyer when placing the order. The delivery address may differ from the billing address.

The Seller undertakes to ship ordered products within an average of 2 to 5 business days after full payment has been received. However, delays may occur in certain situations such as stock shortages or service closures.

In the event of delays or product unavailability, the Seller will inform the Buyer accordingly.

4.3

Delivery times are provided for informational purposes only. Delays shall not justify cancellation of the order or claims for damages.

4.4

If a delivery cannot be completed due to issues attributable to the recipient (incomplete address, missing name on mailbox, unclaimed package within 15 days, etc.), the package will only be resent after payment of additional shipping fees identical to the original shipping costs.

4.5

Information provided by the Buyer at the time of ordering is binding. In the event of an error in the delivery details, the Seller cannot be held responsible for failure to deliver the product.

4.6

Orders may, at the Buyer’s choice:

  • be shipped to the delivery address provided;
  • be delivered by courier;
  • or be collected from Cent Philtres premises at:

subject to express agreement from the Seller and product availability.

4.7

In the event of damage or missing items, the Buyer must notify the Seller by email immediately upon receipt of the order.

If the package was delivered against signature, specific and justified reservations must be noted on the delivery receipt upon delivery.

4.8

Any complaint regarding product quality must be sent by registered mail with acknowledgment of receipt within eight days following delivery.

4.9

For deliveries made without signature, if tracking indicates a status such as “delivered” or “distributed,” no claim may be accepted and the Seller cannot be held liable.

However, the Seller undertakes to carry out the necessary procedures with the carrier until this status is confirmed.

4.10

As the Seller’s products comply with French regulations, it is the Buyer’s responsibility to verify any restrictions applicable within their own territory and confirm whether they wish to maintain or cancel the order.

If the Buyer confirms shipment, they are also responsible for customs clearance and payment of any import duties or taxes.

Without confirmation from the Buyer within 72 hours, the order will automatically be canceled and refunded.

4.11

The Seller cannot be held responsible for customs blockages or seizures in the context of international sales.

No refund or compensation may be claimed in such cases, although assistance may be provided to help regularize the situation.


Article 5 - Right of Withdrawal

5.1

In accordance with the French Consumer Code and Articles L.121-20 and following, the Buyer has a legal withdrawal period during which they may exercise their right of withdrawal without justification or penalties, except for return shipping costs.

The withdrawal period begins on the date the products are received.

5.2

Products must be returned in their original packaging, unused, and accompanied by a copy of the original invoice.

Return shipping costs are borne by the Buyer and are non-refundable.

Cash-on-delivery returns will not be accepted.

5.3

The Seller will refund the amounts paid as soon as possible and no later than thirty (30) days after the withdrawal request.

5.4

E-liquids are excluded from the scope of the right of withdrawal.


Article 6 - Warranty

6.1

Under the legal warranty provided by Articles 1641 and following of the French Civil Code, any defective or non-compliant product may be exchanged subject to return and inspection by a technician.

Products must be accompanied by:

  • the purchase invoice;
  • original packaging;
  • complete accessories.

6.2

The warranty applicable to each product is indicated on its product page on centphiltres.co.

If no warranty is specified, the product is considered sold without warranty.

Products damaged through misuse, falls, excessive tightening, modifications, dismantling, or incompatible equipment are excluded from warranty coverage.

6.3

The warranty specifically excludes damage resulting from improper handling of USB connectors.

Consumable products such as cartridges, cartomizers, clearomizers, and e-liquids are excluded from warranty coverage.

Batteries malfunctioning due to incompatible atomizers, car chargers, or USB chargers from brands not distributed by the Seller are also excluded.

Article 7 - Liability

7.1

As the Seller is not the manufacturer of the products sold on the website, it cannot be held liable for any material, immaterial, or bodily damage resulting from malfunction or misuse of the products.

The Seller’s liability shall in any case be limited to the amount of the order.

7.2

The Seller is only bound by an obligation of means in the online sales process and cannot be held liable for damages resulting from the use of the Internet network, including data loss, intrusion, viruses, service interruptions, or other involuntary problems.

7.3

Products sold by the Seller are intended for vapor inhalation simulation.

The Buyer acknowledges being an adult, informed, and using these products under their sole responsibility.

The Seller cannot be held responsible for any health-related issue affecting the Buyer.


Article 8 - Personal Data Protection

8.1

Personal data collected is processed by Cent Philtres for customer relationship management, loyalty and referral programs, and the sending of news and personalized offers.

8.2

Cent Philtres reserves the right to modify, suspend, or terminate loyalty and referral programs at any time, subject to prior information being provided to members.

Any updated conditions will apply only to operations carried out after the modification date.


Article 9 - Intellectual Property

9.1

All elements of the website centphiltres.co remain the exclusive intellectual property of the Seller.

No one is authorized to reproduce, exploit, redistribute, or use any part of the website, whether software, visual, or audio content, without prior written authorization.

9.2

Photographs displayed on centphiltres.co are non-contractual.


Article 10 - Applicable Law

These online sales conditions are governed by French law.

Any complaint relating to services provided must be submitted in writing by email or through the designated contact form, including all information necessary for its examination.

The company undertakes to acknowledge receipt of complaints and respond within a maximum of 10 business days.

Consumer mediation may only be requested in the event of a genuine, serious, and unresolved dispute following exhaustion of the internal complaint procedure and within two months of the initial complaint.

Manifestly unfounded, abusive, repetitive claims or claims not complying with the described procedure may be challenged by the company before the mediator.
